Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Restaurant Partner", "Merchant", or "User") and KitchenZap. By accessing or using our dashboard, WhatsApp bot engine, and digital table ordering system, you agree to comply with these Terms.
1. Scope of Technology Services & Non-Food Liability
KitchenZap is strictly a software-as-a-service (SaaS) provider. KitchenZap is NOT a food manufacturer, caterer, restaurant, or delivery agency.
- The Restaurant Partner is solely responsible for food freshness, cooking hygiene, FSSAI compliance, accurate menu pricing, dietary indicators (Veg/Non-Veg), and food packaging.
- KitchenZap shall have ZERO liability for food quality complaints, health code violations, food allergies, delays in restaurant preparation, or courier logistics.
2. Prepaid SaaS Wallet & Value-Slab Platform Fees
KitchenZap operates on a transparent, pay-per-accepted-order model with zero fixed monthly subscription burdens:

* Platform fees are deducted only when an order is transitioned to ACCEPTED state by kitchen staff. Orders rejected or cancelled prior to acceptance incur ₹0 fee.
3. WhatsApp Anti-Spam & Meta Compliance
Merchants must strictly adhere to Meta WhatsApp Business Messaging Policies:
- Sending unsolicited bulk marketing messages, phishing links, adult content, or abusive language is strictly prohibited.
- KitchenZap reserves the right to immediately suspend accounts and revoke WhatsApp Cloud API connections if spam complaints or Meta policy violations are detected.
4. Account Termination & Jurisdiction
Either party may terminate this agreement at any time. These Terms are governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
